　　摘 要

　　患者知情同意权是指患者有获知病情并对医务人员所采取的治疗方案决定取 舍的权利。患者知情同意权起源于英美法系，这个概念来源于二战后的纽伦堡审 判。纽伦堡审判中，揭露了纳粹医师在集中营中强迫受试者接受不人道的人体试 验的大量事实，在审判后通过的《纽伦堡法典》中规定：“人类受试者的自愿同意 是绝对必要的”。 纽伦堡审判后，知情同意逐渐应用于医患关系和临床领域。这 一概念也逐渐被各国立法机关予以立法上的承认与保护。

　　我国对患者知情同意权的认知以及立法起步较晚，这也导致了在对该项权利 的立法保护方面出现缺失。现行相关法律条文在有关患者知情同意权的保护方面 缺乏一致性，以至于发生医疗纠纷时不能较为全面的保护患者的相关权利。本文 试图通过从现实角度出发，分析现今我国对该项权利保护现状、优势与不足之处， 大量参阅国内外对于患者知情同意权的研究，充分利用相关文献资料，注重结合 我国实际国情与社会舆论观点，通过对患者知情同意权的概念、特征、来源、历 史演变和我国大陆关于患者知情同意权的相关规定等多方面进行分析阐述，并借 鉴国外相关研究成果，结合实际案例，对患者知情同意权的基础理论以及制度建 设进行探究，希望对患者权利的维护，医患关系的理顺和社会的和谐发展起到促 进作用。本文除引言外，分为五大部分。第一部分主要论述患者知情同意权具体 内涵；第二部分总结典型国家和地区立法现状，主要介绍了美国、日本、台湾各 地对患者知情同意权的保护现状；第三部分主要针对我国国情与该权利实施现状 分析我国领域内立法方面的规定、实施现状与不足之处，综合分析我国在保护制 度方面存在的问题，对比各国的立法分析问题存在的原因；第四部分也是本文最 后一部分，主要通过上述分析，总结我国现阶段对此项权利在立法方面应完善之 处，主要提倡应对权利对象、义务人、实施范围、内容等作出较为详细的立法解 释以及建立（完善）纠纷调解机制加以说明。
