　　为进一步加强大气污染防治，保护人民健康，加强烟花爆竹安全管理，根据《中华人民共和国大气污染防治法》、《中华人民共和国治安管理处罚法》、《烟花爆竹安全管理条例》等法律、法规和规定，现对邯郸市禁止燃放烟花爆竹公告如下:

　　一、禁止排放的时间、区域和品种

　　(一)在本市主城区范围内，全年禁止燃放各种烟花爆竹。

　　(二)在本市主城区范围外，当市政府启动3级以上重污染天气预警时，在预警期内和区域内严禁燃放任何种类的烟花爆竹。

　　(三)全市禁止燃放电子烟花、铁炮、枪支、清扫枪、抛掷枪支等非法、超标、非标准烟花爆竹。

　　(四)本通知所称“主城区”是指西气东输中线总干渠、东起上岱线、北至青兰高速公路、南至二环路(待建)所围成的区域。上岱线是指北顺，沿翰林路、开发区齐静街、会泽路、001乡道经夹口村延伸至青兰高速公路。 南至南二环路。南二环路(待建)是指位于邯郸二环路北侧的干渠1所中学，通过郑家岗村向西延伸至南水北调中线工程。 东经东堤西宝村至上岱线。

　　(五)主城区以外的县(市、区)禁止燃放烟花爆竹的区域，允许燃放时间为除夕、正月初一全天、正月初五、正月十五7: 00至22:00，其他时间禁止燃放。烟花爆竹的具体时间、区域和品种可根据当地情况制定。

　　(6)根据本通知规定的主城区禁止燃放烟花爆竹的年度禁令，禁止在我市通道区域(除夕0: 00至正月16: 24)(从南至磁县市，从北至永年市，从西至南水北调中线总干渠，从东至高铁沿线区域)销售和燃放烟花爆竹。

　　二. 禁止排放的场所

　　100米范围内的加油站(罐)和其他易燃易爆危险品储存场所；安全保护区内的火车站、汽车站、机场等交通枢纽和输变电设施、通信设施；国家机关、重要军事设施、文物保护单位、教学科研单位、医院、疗养院、疗养院等附近地区；公共娱乐场所、集贸市场、商场、繁华街道和交通干道等拥挤场所；走廊、屋顶、阳台、平台和森林、苗圃等重点防火区域；烟花爆竹产品说明书要求的安全距离不足的；市、县政府禁止的其他场所。

　　三、烟花爆竹销售管理及处罚

　　本市行政区域内一般不再增设烟花爆竹批发企业。严禁在城市主城区内设立烟花爆竹零售点，主城区外每个乡镇不得设立3个以上零售点。在丛台区、寒山区、复兴区和邯郸经济技术开发区范围内，行政审批和应急管理部门不批准春节期间设立零售点(临时零售点)。鉴于邯郸市部分行政区划的调整，邯郸市供销社直属烟花爆竹批发企业将保持原有经营区域不变。

　　对擅自销售烟花爆竹的，公安、应急管理等部门应当按照职责分工，按照《安全管理条例》进行处罚 of Fireworks" and the "Public Security Administration Punishment Law of the People's Republic of China". If a crime is constituted, criminal responsibility shall be investigated according to law.

　　Four, fireworks purchase

　　Public security, emergency management, supply and marketing departments are responsible for the construction of the city's fireworks information traceability system and the establishment of a real-name purchase system in the retail sector to realize the information management of the whole process of production, operation, storage, transportation and purchase.

　　Five, fireworks discharge management and punishment

　　If fireworks and firecrackers are set off outside the main urban area, they shall be set off safely in accordance with this circular and the provisions of the local government.Fireworks parties and other large-scale fireworks display activities shall be approved by the public security departments at or above the county level (including the county level) and entrusted to qualified professional discharge units and personnel.For unauthorized fireworks parties and other large-scale fireworks display activities, setting off fireworks at the time and place when setting off fireworks is prohibited, or setting off fireworks in a way that endangers public safety or personal and property safety, the public security department shall punish them in accordance with the relevant provisions of the Regulations on the Safety Administration of Fireworks and Fireworks and the Public Security Administration Punishment Law of the People's Republic of China. Involving national staff illegal, illegal discharge of fireworks and firecrackers causing serious consequences, the transfer of discipline inspection and supervision organs in accordance with discipline and regulations to investigate the responsibility of the relevant units and personnel.

　　VI. Division of Responsibilities

　　(a) the county (city, district) government (CMC) should attach great importance to the ban on fireworks and firecrackers, improve the working mechanism, crack down on illegal production and sale of fireworks and firecrackers, carry out publicity and education, and publish reporting telephone numbers.

　　(two) the public security departments should strengthen the prevention and control of the community, timely discover, stop and investigate illegal discharge, and deal with illegal discharge personnel in accordance with the law.

　　(three) emergency management departments should strengthen the supervision of fireworks wholesale enterprises and retail stores (points), and earnestly perform their statutory duties.

　　(four) the supply and marketing department should strengthen the management of fireworks business units within the system.

　　(5)全市禁止排放范围内的所有机关、企事业单位、街道办事处(乡镇政府)、居(村)民委员会、住宅物业公司和商店是禁止排放的责任单位。 主要负责人是禁令的负责人。 按照本通知和当地政府的规定，做好辖区内居民和从业人员禁止离岗的宣传教育和监督工作。

　　请遵守烟花爆竹禁令，以安全文明的方式燃放烟花爆竹。每个公民都有权利和义务劝阻、制止和举报不文明燃放烟花爆竹、非法销售和燃放烟花爆竹的行为。 报到的电话号码是110。

　　本通知自发布之日起施行，有效期两年。《邯郸市人民政府关于主城区禁止燃放烟花爆竹的通知》(邯2018年第号)4)同时废止。
